TERMS & CONDITIONS

Studio Ninety Five Ltd (“we”, “us”, “our”) operate a bespoke health & fitness studio at Norman Road, St Leonards-on-Sea. These Terms govern all memberships, purchases and use of our services and facilities, including Small Group Personal Training (95 Form), Large Group Training (95 Momentum), Open Gym, Reformer Pilates, the Recovery Suite (sauna & cold plunge), treatments/therapies, goods and assessments.

By purchasing or using a membership, you agree to these Terms.

  1. Definitions

  • Member/you: the individual purchasing a membership, service or goods

  • Minimum Term: the initial commitment period is set out in section 4.

  • Billing Date: the date each month when your fees are collected.

  • Services: all activities, classes, facilities and offerings described above.

2. Eligibility & joining

  • Memberships and services are available to individuals aged 18+. Under-18s require written guardian consent and may be restricted from certain services.

  • You must complete our PAR-Q/health screening and waiver before engaging in any services.


3. Membership types & access

  • Membership tiers, inclusions and access rules are shown at point of sale and in your Mindbody account.

  • Access to sessions is always subject to availability and advance booking via the Mindbody app (or your Mindbody web account).


4. Minimum Term & notice to cancel

  • Minimum Term: All monthly memberships have a 2 month minimum commitment from the membership start date.

  • Notice: After one month you may give one month’s notice by emailing hello@studioninetyfive.uk.

  • Notice takes effect from the 1st day of the next calendar month after we receive it (unless received on the 1st). Fees remain payable during the notice period.

  • Cancellations are not accepted via social media or verbal message; email confirmation is required.

5. Fees, billing & failed payments

  • Membership fees are collected monthly in advance by recurring card or direct debit on your Billing Date.

  • If a payment fails, we will attempt to re-collection and may suspend booking/access until the balance is cleared.

  • We may change prices with at least 30 days’ notice (not during your current Minimum Term).

6. Pauses/suspensions

  • We may, at our discretion, allow a temporary suspension (e.g., medical or extended travel).

  • Suspensions must be requested in advance in writing; evidence may be required.

  • Time on pause does not count towards the Minimum Term or notice period. An admin fee may apply.

7. Bookings, attendance & late cancellations

  • All sessions require advance booking via the Mindbody app (or your Mindbody web account).

  • Booking windows, waitlist rules, late-cancel/no-show charges and session entitlements are as published in the Mindbody app and may be updated from time to time.

  • We reserve the right to remove booking privileges for persistent no-shows/late cancellations.

8. Health, safety & informed consent

  • You confirm you are fit to participate and will disclose relevant medical conditions/medications (including pregnancy/post-partum) and update us if anything changes.

  • You agree to follow coach/staff instructions and all posted rules, including specific guidance for Reformer use, group training and equipment setup.

  • You should stop any activity at any time and should report discomfort or pain immediately.

9. Recovery Suite (sauna & cold plunge)

  • Heat/cold exposure involves additional risks (e.g., dizziness, blood-pressure changes, cardiac stress, cold-related injury).

  • Contra-indications include, but are not limited to: unstable cardiovascular disease, uncontrolled hypertension, fever, open wounds/skin infection, certain neurological conditions and pregnancy. Seek medical advice if unsure.

  • Use only during staffed hours and follow time/temperature and hygiene rules. No breath-holding in the cold plunge.

10. Open Gym

  • Open Gym is not a coached session. A staff member is present for general assistance only. You are responsible for safe equipment use, racking weights and leaving the area tidy.

11. Reformer Pilates & equipment use

  • Reformer apparatus contains moving parts and must be used only as instructed. Follow spring/tension setups and request alternatives where needed.

12. Conduct & studio use

  • Maintain appropriate conduct, attire and hygiene; wipe down equipment after use.

  • We may suspend or terminate membership for serious or repeated breaches of these Terms or for conduct that risks safety or disrupts the studio environment.

13. Personal property

  • You are responsible for your belongings. We are not liable for loss, theft or damage to personal property on the premises.

14. Changes to services & timetable

  • We may make reasonable changes to opening hours, timetables, facilities, coaches and class formats. Where changes are material, we will give as much notice as practicable.

15. Termination by us

  • We may terminate a membership with immediate effect for non-payment, serious breach of these Terms, unsafe behaviour, or misuse of facilities. Any outstanding fees remain payable.

    Harassment of Staff

  • The Gym maintains a zero-tolerance policy towards any form of harassment, abuse, or inappropriate behaviour directed at its staff by customers or third parties.

  • Harassment includes, but is not limited to, verbal abuse, physical intimidation, offensive language, discriminatory remarks, or any conduct that creates a hostile, intimidating, or offensive environment for staff.

  • Any customer found to have engaged in harassment of staff will face immediate action, which may include suspension or termination of their membership without refund, and, where appropriate, legal action.

  • The Gym reserves the right to report any incidents of harassment to the relevant authorities and to cooperate fully in any subsequent investigations.

  • Customers are encouraged to report any concerns or incidents of harassment to management promptly to ensure a safe and respectful environment for all.

16. Data protection (UK GDPR)

  • We process your personal data (including health information you provide) to deliver services safely and manage your membership.

17. Liability

  • Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under UK law.

  • Subject to the above, to the fullest extent permitted by law, we are not liable for any loss or damage arising from your participation where not caused by our negligence.

18. Complaints & contact

  • If something isn’t right, please speak to a manager on site or email hello@studioninetyfive.uk. We aim to resolve issues promptly and fairly.

19. Governing law

  • These Terms are governed by the laws of England & Wales and the courts of England & Wales shall have exclusive jurisdiction.

20. Acceptance

  • By purchasing or using a membership, you confirm you have read and agree to these Terms. For monthly memberships, your agreement renews automatically until cancelled in accordance with section 4.
